Governor Koster Gives Investor 6 Months to Dismantle the Kelingking Beach Glass Viewing Platform at Nusa Penida for Five Serious Violations

DENPASAR, Balitopnews.com - The Governor of Bali Wayan Koster responded to the Bali Provincial DPRD's recommendation, No.B.08.500.5.7.15/31529/PSD/DPRD, regarding the construction of the Kelingking Beach Glass Viewing Platform in Bunga Mekar Village, Nusa Penida, Klungkung Regency, which was found to have committed 5 violations.
The first is a Spatial Planning Violation, as regulated in Bali Provincial Regulation Number 3 of 2020 concerning Amendments to Bali Provincial Regulation Number 16 of 2009 concerning the Bali Spatial Planning Plan (RTRWP) 2009-2029. The following violations were committed: • The construction of a Glass Viewing Platform with an area of 846 m2 and a height of approximately 180 m, along with supporting tourism structures, is located within a cliff boundary area and does not have a Recommendation from the Governor of Bali, as required. • The foundations (bore piles) for the bridge and Glass Viewing Platform are located in coastal areas and do not have a Recommendation from the Governor of Bali and do not have a Marine Spatial Utilization Permit (KKPRL) from the Ministry of Maritime Affairs and Fisheries. The Governor of Bali does not have a Recommendation from the Governor of Bali regarding the cliff stability study. There is no validation of KKPR for foreign direct investment (PMA) issued automatically through the OSS before the enactment of Government Regulation No. 28 of 2025. Most Glass Viewing Platforms are located in coastal waters that lack a basic permit for Marine Spatial Utilization Activities (KKPRL) from the Ministry of Maritime Affairs and Fisheries. Administrative sanctions include demolition of the buildings and restoration of the spatial function.
Second, Environmental Violations, as regulated in Government Regulation Number 5 of 2021 concerning the Implementation of Risk-Based Business Licensing. Type of Violation: Failure to obtain an environmental permit for PMA activities, which falls under the authority of the Central Government. Only a UKL-UPL Recommendation issued by the Klungkung Regency Environment and Land Agency. Administrative sanctions include government coercion for demolition.
Third, Licensing Violations, as regulated in Government Regulation Number 5 of 2021 concerning the Implementation of Risk-Based Business Licensing. Type of Violation: Spatial Utilization Activities (KKPR) do not align with the designated spatial plan. Building Approval (PBG) is only for the Ticket Counter (Entrance and Ticketing) building with an area of 563.91 m2, which does not include the 42 m long Connecting Flyover and the Glass Viewing Platform with an area of 846 m2 and a height of approximately 180 m. Sanction: Cessation of all activities.
Fourth, violations of Marine Spatial Planning, as regulated by Law Number 27 of 2007 concerning Coastal Area Management, are outlined in Bali Governor Decree No. 1828 of 2017 concerning the Management Plan and Zoning of the Nusa Penida Marine Conservation Area in Bali Province. Type of Violation: Concrete foundation structures (bore piles) constructed within the Marine Conservation Area, within the sustainable fisheries zone, or traditional fisheries subzone, are prohibited from constructing tourist structures, including elevators. Administrative sanctions include demolition of the structures.
Fifth, violations of cultural-based tourism, as regulated by Bali Provincial Regulation Number 5 of 2020 concerning Standards for the Implementation of Balinese Cultural Tourism. Type of Violation: Changing the originality of a Tourist Destination Area (DTW). Criminal sanctions.
The Governor of Bali Wayan Koster explained to reporters on Sunday (November 23, 2025) that he had received four recommendations from the Bali Provincial Council (DPRD).
First, halt all construction activities of the Glass Viewing Platform in Banjar Karang Dawa, Bunga Mekar Village, Nusa Penida District, Klungkung Regency, by PT Indonesia Kaishi Tourism Property Investment Development Group.
Second, close and dismantle the Glass Viewing Platform in Banjar Karang Dawa, Bunga Mekar Village, Nusa Penida District, Klungkung Regency, by PT Indonesia Kaishi Tourism Property Investment Development Group.
Third recommendation: All costs incurred in dismantling the Glass Viewing Platform in Banjar Karang Dawa, Bunga Mekar Village, Nusa Penida District, Klungkung Regency are the sole responsibility of PT Indonesia Kaishi Tourism Property Investment Development Group, within the specified timeframe and in accordance with applicable regulations. Fourth recommendation: If the dismantling of the Glass Viewing Platform in Banjar Karang Dawa, Bunga Mekar Village, Nusa Penida District, Klungkung Regency is not carried out by PT Indonesia Kaishi Tourism Property Investment Development Group within the specified timeframe, the Klungkung Regency Government, in conjunction with the Bali Provincial Government, will demolish the building in accordance with applicable laws and regulations.
"The Regent of Klungkung and I have taken a firm decision. We have identified five very serious violations and are considering the future interests of Bali, including preserving the natural, human, and cultural heritage of Bali, as well as implementing culture-based, high-quality, and dignified tourism," Governor Koster asserted.
Governor Wayan Koster, accompanied by The Regent of Klungkung I Made Satria and the Chairperson of the Special Committee on Spatial Planning, Assets, and Licensing (TRAP) of the Bali Regional People's Representative Council (DPRD), I Made Suparta, decided to take decisive action. They ordered PT Indonesia Kaishi Tourism Property Investment Development Group to halt all construction activities on the Glass Viewing Platform, to demolish it independently within a maximum of six months, and to restore the space's function after the demolition within three months. "If the investor, PT Indonesia Kaishi Tourism Property Investment Development Group, fails to carry out the demolition independently within the specified deadline, the Bali Provincial Government and the Klungkung Regency Government will carry out the demolition in accordance with statutory regulations," Koster emphasized.
