Request for judicial review of Governor Regulation No. 97 of 2018, concerning the Limitation of Disposable Plastic Waste that was submitted by the Indonesian Plastic Recycling Association (ADUPI) was rejected by the Supreme Court (MA). In addition to being rejected, the applicant was also sentenced to pay court fees.
The Governor of Bali, Wayan Koster, revealed that this regulation is a concrete step to reduce plastic waste with a policy of prohibiting. With this refusal, it shows that this policy has a strong and legitimate legal position throughout Bali.
"So the issuance of the Governor Bali Regulation is in accordance with the Law on regional government," Koster told journalists, in Jayasabha, the Governor's Bali Office, on Thursday (July 11, 2019).
Previously, the Governor of Bali was accused of having made new norms beyond his capacity as stipulated in Law Number 23 Year 2014 concerning Regional Government and Law No. 18 of 2008 concerning Waste Management and Bali Provincial Regulation No. 5 of 2011 concerning Waste Management.
However, it is precisely the norm of waste reduction stipulated in Law No. 18 of 2008 and Bali Provincial Regulation No. 5 of 2011 concerning Waste Management, must be interpreted as a prohibition on the use of disposable plastic, as stipulated in the Governor Bali Regulation No. 97 of 2018.
"In this Governor Bali Regulation it is prohibited, but it is the implementation of the Act on it relating to waste management efforts. With this Supreme Court ruling, now all parties must carry out the Bali Governor Regulation to maintain the sanctity of the island of Bali and the sustainability of the environment,"Koster said.
Koster also expressed his gratitude to the central government and all parties, both environmental activists in Indonesia, especially those in Bali, as well as activists from various countries, as well as public policy observers who have supported Governor Bali Regulation No 97/2018.
For this reason, he invited all parties to attend Bali, and will hold a banquet as a form of appreciation and expression of gratitude. Governor Koster to invite the parties together at the upcoming anniversary celebration of the Bali Provincial Government, 14 August 2019.

On that occasion, Governor Koster also conveyed a message, so that the plaintiffs could accept the Supreme Court's decision in a timely manner because this was for the sake of our environmental sustainability, he advised the plastic waste recycling business players, especially those at ADUPI, to switch raw materials.
"Do not depend on the same material. Begin to turn to other materials that are more environmentally friendly, lest the economic value will be higher, and so that it will not damage the environment.
