Koster Represents Enforcement of Customary Village Regional Regulation in Samuhan Tiga Temple

The Governor of Bali Wayan Koster officially launched the implementation of Regional Regulations (Perda) Number 4 of 2019 concerning Customary Villages in the Province of Bali, Tuesday 4 June 2019 in Wantilan Temple in Samuhan Tiga, Bedulu Village, Gianyar Regency.

 

The announcement was marked by the signing of the inscription, which was greeted by a thunderous applause from thousands of invitations consisting of Sulinggih and Pinandita, Deputy Governor of Bali Tjokorda Oka Artha Ardhana Sukawati, Deputy Chief of Bali Regional Police Brigadier General (Pol) Drs. I Wayan Sunartha, Chairperson of Bali DPRD, Adi Wiryatama, Regent and Mayor, Main Assembly and Pekraman Village Intermediate Assembly, Religious Community Communication Forum (FKUB), Parisada, Village Head and Village Head, and Bendesa from 1,493 Pekraman Villages in Bali.

 

 

The declaration of this Customary Village Regulation is a historical moment because for the first time Adat Village, the most important cultural institution in Bali, was recognized as a legal subject with clear positions and authority.

 

In addition, this declaration is also a historic moment because it is a continuation of the milestone that Ida Bhatara Mpu Kuturan built in 1000 years ago.

 

In his position as principal adviser to King Udayana Warmadewa and Ratu Gunapriya Dharmapatni, Mpu Kuturan in meetings at the Temple of Samuhan Tiga with religious and community leaders gave birth to fundamental structures for Balinese people, including Desa Adat, Kahyangan Tiga, and sanggah Rong Tiga.

 

 

 

"This legislation was made to preserve what has been designed by Ida Bhatara Mpu Kuturan. The aim is for Indigenous Villages to be stronger and stronger, while at the same time being able to accommodate the challenges and opportunities of the times, " Koter said.

 

The Chairperson of the PDI Perjuangan DPD Bali revealed that the draft Regional Regulation had been drafted since 2014 when he was still a member of the DPR RI. During that time Ida Bhatara Mpu Kuturan always adored his in his prayers.

 

"I always remember Ida Bhatara Mpu Kuturan, I beg for your guidance. If what I do is right so that it is given a way, if it is wrong, it will be stopped, " Koster  added.

 

 

The declaration of the enactment of the Customary Village Regional Regulation is also an event full of symbols. Perda No. 4 was proclaimed on the 4th on Anggara Kasih Kulantir, a holy day which is believed to be the time of the Ida Bhatara Siwa meditate. Koster himself was born to Anggara Kasih Tambir.

 

Before the commencement of the ceremony, Koster and the officials held a prayer ini Samuhan Tiga Temple.

 

"I reported and released the assignment to Ida Bhatara Mpu Kuturan. This regulation has been completed, we ask Ida Bhatara to be guided and assisted during the implementation, "he said.

 

 

Regional Regulation Number 4 Year 2019, which consists of 18 Chapters and 104 Articles, according to Koster is the implementation of the vision of Nangun Sat Kerthi Loka Bali through the Pattern of Development of the Universe towards the Bali New Era.

 

"The basic concept must not deviate from local wisdom. "It must be perpendicular to the local wisdom," he stressed.

 

 

Substantially, Perda Number 4 Year 2019 concerning Customary Villages in Bali does not refer to Law 6/2014 concerning Villages, but refers to Law 23/2014 concerning Regional Government, Article 236 paragraph (4), which states that Regional Regulations can load material local content in accordance with statutory provisions.

 

This historic regulation contains a number of new and progressive provisions.

 

 

Therefore, the understanding of Adat Village in Perda Number 4 Year 2019 concerning Customary Villages in Bali is specifically, different from the definition of Traditional Village in Law 6/2014 concerning Villages.

 

 

Due to referring to Law 23/2014 on Regional Government, Customary Villages in this Regional Regulation have territory, origin rights, traditional rights, original arrangements, and original autonomy to regulate and manage their own households.

 

 

Through this regulation, for the first time Adat Village was officially and explicitly recognized as a legal subject with clear and firm legal standing.

 

 

Balinese custom must be managed in a unit of Bali, cannot be managed partially per Regency / City area, so that Bali Indigenous become a strong identity unit for Balinese people.

 

The Regional Regulation also contains clear arrangements regarding the Krama category along with their respective swadharma (obligations) and self-reliance (rights), which consist of: (Article 8) Traditional Village, namely Balinese Hindu community members hyang Mipil and recorded in the local Customary Village; Krama tamiu, which is a Balinese Hindu citizen who is not Mipil but is registered in the local Adat Village; and Tamiu, namely people other than Krama Adat Village and Krama Tamiu who were temporarily in the Adat Village Village or residing and registered in the local Customary Village.

 

 

 

 

 

"In Bali, it is an obligation that is carried out first and then asks for rights. If you ask for rights first it will be noisy, so in Bali it's Karma Phala, doing karma first and then asking for reward, "Koster said.

 

 

It was also regulated that the affirmation and expansion of the duties and authority of the Desa Adat included local authority in the name of the Adat Village. (Article 21-25)

 

The Regional Regulation also confirms that changes in the status of rights and functions of the Customary Village land must be carried out based on an agreement through the relevant Customary Village / Banjar Adat Village. (Article 11)
